What kind of USB to serial device do you have? It works for me for just the USB/serial cable with nothing connected to it: lsusb grep -i serial Bus 002 Device 004: ID 067b:2303 Prolific Technology, Inc.

In case the driver for your device does not support TIOCGSERIAL, the 'invalid argument' is returned. On the other hand statserial uses TIOCMGET, so depending on the kernel one or the other feature might not work.
